DMCA Takedown Procedures

1. Copyright Respect Policy
Campsite Finder respects the intellectual property rights of others and expects our users to do the same. We have adopted this Copyright Policy in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws to address claims of copyright infringement on our platform.
2. DMCA Takedown Process
Important Notice
If you believe that your copyrighted work has been used on our platform in a way that constitutes copyright infringement, you may submit a takedown notice under the DMCA.
2.1. Filing a DMCA Notice
To file a valid DMCA takedown notice, you must provide the following information:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
- Your contact information (address, telephone number, and email address)
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

4. Counter-Notification Process
4.1. If Your Content Was Removed
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification.
4.2. Counter-Notice Requirements
Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that has been removed and the location where it appeared
- A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the Federal District Court for your judicial district
- A statement that you will accept service of process from the person who provided the takedown notice
5. Response Timeline
Initial Response
We will acknowledge receipt of valid DMCA notices within 24-48 hours and take appropriate action.
Content Removal
Infringing content will be removed or disabled within 72 hours of receiving a valid notice.
6. Repeat Infringer Policy
Account Termination
Users who are found to be repeat infringers will have their accounts terminated and will be permanently banned from using our services. We maintain a policy of terminating accounts of users who have been determined to be repeat infringers.
7. User Responsibilities
7.1. Original Content
Users are responsible for ensuring that all content they upload (photos, tips, reviews) is either their original work or used with proper permission.
7.2. Photo Attribution
When uploading photos, users must have taken the photo themselves or have explicit permission from the copyright holder.
7.3. Respect Others' Rights
Do not upload content that infringes on trademarks, copyrights, or other intellectual property rights of others.
8. Fair Use and Exceptions
Fair Use Guidelines
We recognize that certain uses of copyrighted material may be considered "fair use" under copyright law. However, fair use is determined on a case-by-case basis considering factors such as:
- Purpose and character of the use
- Nature of the copyrighted work
- Amount used relative to the whole work
- Effect on the market for the original work
9. False Claims
Penalty for False Claims
Under the DMCA, anyone who knowingly materially misrepresents that content is infringing may be liable for damages. This includes false takedown notices and false counter-notifications.
